Common creditor action violations involve:

  • Failing to identify themselves as debt collectors, but only give the company name
  • Failing to limit their inquiries to the three legally permissible questions: Last known phone number, place of residence and place of work
  • Disclosing to third parties (such as employers, neighbors, friends or family members) that you owe debt, including, but not limited to, credit card debt
  • Contacting you after discovering you are represented by an attorney
  • Violating time of day specifications (calling you before 8:00 am and after 9:00 pm local time)

  • Calling you after you, in writing, tell them that you are not going to pay the debt, you deny owing the debt, or that you want them to stop communicating with you
